But I agree. This has been going on for too long and it is obvious, I think, to the average person that Nissan Motors is not right to call this guy a cybersquatter or a TM infringer in anyway let alone try to ????: NamePros.com http://www.namepros.com/domain-name-discussion/17029-nissan-com.html get millions from him and ruin his life as a result. The guy's last name is Nissan and he was faster to register it for his own business that used his last name BEFORE Nissan Motors was Nissan at all. I don't even care if Mr. Nissan registered the domain after they changed Datsun Nissan or if Mr. Nissan did not own a business using his last name. The fact is that it IS his last name and he was faster and had more vision of the future to register the name - HIS LAST NAME. If corporations are allowed ot sue over TM infringements, then I say that people should be allowed to sue over family name infringement. If soemone starts a company called Smith's cars and Smith is not the last name of the founding principl(s), then any and all people with the last name smith should be allowed to stop them from using the last name for a fictitious business name. OK. Smith is a bad example but you get the idea. Ferrari would have been a better example. Only in a just world would this be the case. But since we do not live in an even remotely just world... money talks and the US government favors big corporations over anything, even the well-being and prosperity of it's own citizens. Perhaps all governments are the same but this is the only one I live under and pay taxes to.
Quite different case altogether. This one is even more of a stupid lawsuit, though, because there is no way in hell that mikerowesoft.com would ever be confused or mistyped for microsoft.com. No way in hell. Microsoft owning such a domain would never benefit the company nor would the kid owning it do any harm to the company. It was a worthless case, MS ended up shelling out a coule thousand for the domain ( I think ) in a settlement from what I hear. This case also reinforces my theory of our nasty government and judicial system (above). | ||||||||
